Maybe contact Home School Legal Defense Association http://www.hslda.org/ NY has some pretty heavy Homeschool standards, but even we only test every other year starting in 4th grade. Many people delay academics until kids are a little older. It is in your rights to homeschool your kids, even if they are not "at grade level". Many parents of autistic or other special needs kids homeschool and do not have to pass the tests,but only show one years growth.Good luck.
