Actually it is not theft and it is not the seller's responsibility to ensure that your package arrives if she can prove she shipped it (postal receipt) and you didn't request insurance or tracking of some sort. She can't be responsible for the postal system. Also, buying from a private seller is like buying something at a garage sale; you wouldn't get a refund at that level either. Sorry. If you spend more than you want to lose you should ALWAYS buy the insurance. I would request a copy of the postal receipt. If she can't prove she mailed it then she may be willing to give you a full or partial refund at her discretion. (That is what I do in any case; if I can't prove I mailed it then I am willing to do a refund; otherwise not since there are SO many people who will just say they didn't get something so they will get the item AND their money.)
