Subject:         Is that theft ?

I need your advice. I bought a set of 5th grade math books back in early September. I paid with a check and waited. After 3 weeks, I emailed the lady and asked her if she had gotten my check. She answered that she had mailed the books the week earlier. So I waited some more thinking that sometimes media mail is very slow. In October, I emailed her back and asked her if she had any news about the books. She replied that the PO Atlanta Recovery Center had sent her a letter saying the box had been damaged and they wanted a description of the content. She told me she filled the form so I waited for the books to be recovered. In February, I emailed her back asking for any news about the books. She responded that she had emailed me a long time ago (I never got that email) saying that the PO acknowledged that the package was lost for good and ended the email saying :"I don't know what to tell you". I emailed her back very politely that I would like a refund since I never received the books that I paid for and it was the seller's responsibility to assume the risk/loss. She has not returned my email... What else should I do ?? Please help.
