No, PayPal will not refund the money. Because the seller had a delivery confirmation # PayPal ruled that the seller shipped the package and I received it. Open and closed case.
(The fact that the box was empty did not seem to matter. (It would be better policy on the part of the USPS, when they process an empty box to tape it up and send it back to the shipper and not on to the receiving address.)
The buyer is assuming all the risk. If the seller does not tape the box closed it's the buyers loss...the buyer is also at risk of being on the receiving end of a scam. such as the seller selling books he does then claiming they were lost in the mail.

PayPal closed the case as soon as they made the ruling. Who ever was reviewing the case did not read my email about the issue very carefully...
I've tried to call PayPal, but I get a maze of phone options that seems imposable to get through...I've also tried to re-open the case from the PayPal website and it just keeps telling me the case is closed. There's not as much safety in using PayPal as I once thought there was.

Lesson learned...If you buy on the message boards have the shipper insure the package!
