He has all the options!! Nothing is right nor wrong. He's just plain *not* housetrained at all.
Somehow people think Chihuahuas can't go 'out' when it's cold. That's truly not accurate. But choose ONE way and train him. Either in or out. Truly you can't have it both ways.
When he is not with you (when you are gone) he should be in a crate with the door shut. What's the point of a crate with the door open? It's pointless.
Honestly he should be in the bedroom with you (in a crate if you'd prefer) so you can hear when he's up and rattling around so you can take him out if he's not learned to hold it thru the night.
When you're home, just plain leash him TO you so you can see everything he does and if he begins to be agitated and sniff or circle take him to the paper or take him out, whichever you've decided.
AT this point he's confused -- he thinks it doesn't matter. There is nothing inate about "in" or "out" -- and you really have to do one or the other.
When he goofs and elminates in an inappropriate place, put him in his crate while you clean up. Then pick up the waste and put it outside where you want him to go or on the paper - whichever you've chosen. Take him back there and show him you've moved it.
But make it crystal clear to him. There is ONE place to go -- *here* (in or out -- whichever you've chosen).
